Bankruptcy attorney Houston and chapter 13 advices

Chapter 13 lawsuits by bankruptcy attorney Houston, Texas: Folks often have the misconception that if the lawsuit is not placed in their hands, they cannot be served and the lawsuit cannot proceed. This is not true and sometimes if you are served by alternative service you may not realize you have been served (if, for example, the lawsuit is affixed to your door and a nosy neighbor takes the lawsuit). If you are aware a lawsuit has been filed, do think if they have not put the lawsuit into your hands that the lawsuit cannot proceed. A lawsuit begins when the ‘Plaintiff’ (the person or company doing the suing) files the ‘Original Petition’ in the appropriate court. If the dollar amount the creditor is suing for is less than $10,000, the lawsuit will usually (but not always) be filed in a ‘Justice of the Peace’ court. Otherwise a lawsuit for an unpaid debt will typically be filed in the county court or district court for the county in which you live.

Moving expense to take first job: Here’s an interesting dichotomy: Job-hunting expenses incurred while looking for your first job are not deductible, but moving expenses to get to that first job are. And you get this write-off even if you don’t itemize. If you moved more than 50 miles, you can deduct 23 cents per mile of the cost of getting yourself and your household goods to the new area, (plus parking fees and tolls) for driving your own vehicle. However, beginning in 2018, moving expenses are no longer deductible for federal taxes unless you are in the military and the move is due to military orders. Some states such as California continue to provide this tax benefit.

What Debts Are Discharged in Chapter 7 Bankruptcy? A Chapter 7 bankruptcy will generally discharge your unsecured debts, such as credit card debt, medical bills and unsecured personal loans. The court will discharge these debts at the end of the process, generally about four to six months after you start. Some types of unsecured debts usually aren’t discharged through a Chapter 7 bankruptcy, including: Child support, Alimony , Student loans, Some tax debt, Homeowners association fees, Court fees and penalties, Personal injury debts you owe due to an accident while you were intoxicated, Unsecured debts that you intentionally left off your filing.

Make 401(k) and HSA Contributions: People can make tax deductible contributions to traditional IRAs up to April 15 of next year. However, the door closes on Dec. 31 for 401(k) and health savings account contributions. “It’s a hard stop,” says Wendy Barlin, a Los Angeles-based CPA and author of “That’s Deductible!: Simple Tips and Tricks to Find More Business Tax Deductions.” “Whatever opportunities you have at work (for retirement savings), make sure you maximize them before the end of the year,” she says. Taxpayers with a qualified high-deductible family health insurance plan can deduct up to $7,000 in contributions to a health savings account. Individuals with self-only coverage can deduct $3,500. Those age 55 or older are eligible for an additional $1,000 catch-up contribution. Tax deductible contributions to a traditional 401(k) are capped at $19,000 for 2019. Workers age 50 and older can make an additional $6,000 in catch-up contributions. See additional info at ryan dove bankruptcy attorney.

Who Should File Chapter 13 Bankruptcy? Many people think of bankruptcy court as the final stop on a path to financial ruin, the only option left when repaying debts seems impossible. But there’s hope even in bankruptcy, and Chapter 13 of the federal bankruptcy code offers the closest thing to a soft landing. Sometimes called the Wage Earner’s Bankruptcy, Chapter 13 allows those with enough income to repay all or part of their debts an alternative to liquidation. It’s bankruptcy for those whose biggest problem is dealing with creditors’ demands for immediate payment, not lack of income.

Business law firm in San Antonio, Texas

The more accurately and thoroughly you can document your claim, the better your chances of maximizing your personal injury settlement. Insurance companies keep records of all claims ever made and share that information with each other through their Comprehensive Loss Underwriting Exchange Database. Once the insurance company has your identifying information, i.e. your name, date of birth and SSN number, the insurance company is certain to find virtually any claims you have ever made in any state.

Cases involving child protective services are serious and should not be taken lightly. Even if your case is just a simple misunderstanding, you don’t want to face legal proceedings alone. An investigation can quickly turn into a removal proceeding, which if requested by the department, can expose parents to the possibility of having their rights terminated if the department and Judge do not believe the parents can meet the needs of their child(ren).

If in your first conversation, the adjuster makes an offer so low that it is obviously just a negotiating tactic to see if you know what your claim is really worth, do not immediately lower the amount you put in your demand letter. Instead, ask the adjuster to give you the specific reasons why the offer is so low. Make notes of the conversation. Then write a brief letter responding to each of the factors the adjuster has mentioned. Depending on the strength of any of the adjuster’s reasons, you can lower your demand slightly, but before lowering your demand very far, wait to see whether the adjuster will budge after receiving your reply letter. The next time you speak with the adjuster, begin by asking for a response to your reply letter. The adjuster should now make you a reasonable offer upon which you will be able to bargain and arrive at a fair final settlement figure. Read more details on here.

Clients don’t like lawyers who kill their deals but appreciate lawyers who understand their business and help them mitigate real risk.”

In 2013, Glyne Harris was made the Executor of a £1.2 million estate. Harris filed the Inheritance Tax Return and paid the initial Inheritance Tax that was due. As a large part of the estate was property, it was possible to pay the Inheritance Tax on the property in instalments. Harris made the mistake of paying the estate out to a beneficiary on the understanding that the beneficiary would settle the remaining IHT bill. Unfortunately for Harris, the beneficiary swiftly disappeared to Barbados without paying the remaining Inheritance Tax. Harris as the Executor was liable to pay the remainder of the £340,000 tax bill personally. Without the estate funds at his disposal, Harris appealed saying that he should not be liable, however a judge ruled that he is in fact personally liable. HMRC could potentially go after Harris’ own assets including his house. Whilst this is an extreme example of what can go wrong, it shows the responsibilities of being appointed an Executor and the advantage that having a professional can have.

A Deed of Variation is an instrument by which, after a death, a beneficiary can divert their entitlement under a Will or Intestacy to somebody else. The effect of using a Deed of Variation rather than the person just gifting their legacy or entitlement to a third party is that there are no tax consequences for the original beneficiary, it is deemed as though the deceased made the gift. The terms of the Deed of Variation are ‘written back’ into the Will or alter the Intestacy Rules for Inheritance Tax and Capital Gains Tax purposes.

The first stage in attempting to recover your debt is to send the debtor a letter of claim. Realistically, the debtor has 3 options at this stage: To pay in full – If payment in full is simply received following the letter of claim then we will limit our fee to £50.00 (excl. VAT). To dispute the debt – If the other party raises a dispute at any point, then we will assess the points in dispute together with you and advise you on your further options. If the debt is disputed then your case will no longer fall within our undisputed debt collection fixed fee scheme and your will be provided with further costs estimates for the options available to you. To fail to respond – If the debtor fails to respond to the letter of claim at all, then the claim will be issued at Court. If there is no response after issue, then we will ask the Court to grant you Judgment in default against the debtor. If the debtor still fails to pay upon receiving a County Court Judgement (CCJ) then we will advise you upon the enforcement options available to you and the costs that entails to pursue the debtor further.

We are in a position to fully advise you at all stages of any dispute with Social Services, from child protection conferences through to the court proceedings. We would not recommend that you include all company decisions in the “unanimous” box as this may prevent the company from actually carrying on any business at all. Investment protection upon sale…tag along… As a minority shareholder you may want a provision to be included in the shareholders’ agreement which requires that, upon the majority shareholder receiving an offer for his/her shares, you as the minority shareholder must be offered the same offer for your shares. This is often referred to as a “tag-along” provision. How does a Shareholders’ Agreement Help a Majority Shareholder? As a majority shareholder (more than 50% of shares), you may want to sell your shares but a minority shareholder is unwilling to agree, then you can include a provision in the shareholders’ agreement which forces the minority to sell their shares. This will allow you as the majority shareholder to realise your investment at a time and price that suits you. The price offered for the shares must be fair for all shareholders, including the minority.

A break clause is written into the commercial lease from the outset and allows a Tenant (and even a Landlord) to end a lease early by serving a notice on the other party. The lease will set out certain requirements that must be followed to ensure the break is valid, for example, the Tenant may be required to give the Landlord notice that they wish to enact the break clause, and all outstanding monies due must be paid. On the other hand, a Tenant may find that the preconditions set by the Landlord mean that the break clause is, in reality, incapable of being exercised. If both parties opt out of the legislation as part of the lease, there is no automatic right to security of tenure. Under these circumstances, a Tenant can vacate the property without providing notice by informing the other by writing. If a Tenant refuses to vacate the property, the Landlord will usually need to undertake possession proceedings. Read extra details at here.

Legal representation is strongly advised as, if unsuccessful, you may be liable for substantial costs. Once a vehicle is seized, we must act quickly: there are strictly enforced time limits which, if missed, can result in the permanent loss of the vehicle.

San Antonio custody attorney by EstorgaLaw? If you were wrongfully injured, you deserve fair compensation. The more accurately and thoroughly you can document your claim, the better your chances of maximizing your personal injury settlement. This might include demonstrating how the at-fault party’s actions caused your accident and injuries. Take photos of the accident scene and collect contact information from any witnesses that are present. You’ll also need to get a copy of your police report.

Keep your attorney informed of anything that might affect your case. Certainly nothing should be signed without first consulting the attorney. Applications for insurance benefits, reports to the State, any change in doctors, returning to work, any change in treatment, etc., should be reported promptly. Disability or unemployment applications should first be checked by the attorney. Keep your attorney advised of any vacation times when you may not be available. An emergency telephone number and an alternative way of reaching you must be in your attorney’s file at all times.

During negotiations, mention any emotional points supporting your claim. If, for example, you have sent the adjuster a particularly strong photo of a smashed car or a severe-looking injury, refer to it. If there was a bottle of beer found in the other party’s car, refer again to the possibility of alcohol use. If similar accidents had occurred in a similar way at that location, remind the adjuster. If your injury interfered with your ability to care for your child, mention that your child suffered as a result. Even though there is no way to put a dollar value on these factors, they can be very powerful in getting an insurance company to settle an accident claim.

I work with clients to counsel and draft paperwork to protect their best interests for favorable outcomes in the event of a divorce or annulment process. It is presumed by Texas Law that the follow percentages are both reasonable and in the best interest of the child(ren) for purposes of determining child support. While Texas child support guidelines are presumptively what should be paid, the Courts may adjust these percentages if the Court determines that the use of these guidelines would be unjust or inappropriate.
